1. Agreement to Terms

By accessing or using LaunchChat ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

LaunchChat is an AI-powered documentation chatbot platform that transforms your documentation (from Notion, uploaded files, or websites) into an embeddable support widget. The Service uses retrieval-augmented generation (RAG) to answer questions based on your content with citations.

3. User Accounts

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You are responsible for all activities that occur under your account

4. Subscription and Payments

LaunchChat offers subscription-based pricing. By subscribing to a paid plan:

  • You authorize us to charge your payment method on a recurring basis
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Prices may change with 30 days' notice before your next billing cycle
  • All fees are exclusive of applicable taxes unless stated otherwise

5. Refund Policy

We want you to be satisfied with LaunchChat. Here's our refund commitment:

  • Response Time: We will respond to all refund requests within 3 business days
  • Eligibility: Refund requests made within 14 days of initial purchase or renewal will be considered on a case-by-case basis
  • Prorated Refunds: For annual plans cancelled mid-term, we may offer a prorated refund for unused months
  • How to Request: Email support@launchchat.dev with your account email and reason for the refund request

Refunds are processed through the original payment method and may take 5-10 business days to appear.

6. Cancellation

You may cancel your subscription at any time:

  • Self-Service: Visit the Billing page in your dashboard to cancel instantly
  • By Email: Send a cancellation request to support@launchchat.dev
  • Your access continues until the end of the current billing period
  • No partial refunds for unused time unless covered by our refund policy

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload content that infringes on intellectual property rights
  • Attempt to gain unauthorized access to our systems or other users' data
  • Use the Service to distribute malware or harmful content
  • Abuse the AI to generate harmful, misleading, or inappropriate content
  • Resell or redistribute the Service without authorization

8. Content Ownership

  • Your Content: You retain all ownership rights to content you upload or connect to LaunchChat. You grant us a license to process and display this content solely to provide the Service.
  • Our Service: LaunchChat, including its design, features, and code, remains our intellectual property.
  • AI Outputs: Responses generated by the AI based on your content are considered derivative of your content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAUNCHCHAT AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT AI RESPONSES WILL BE ACCURATE, COMPLETE, OR ERROR-FREE. YOU ARE RESPONSIBLE FOR REVIEWING AI-GENERATED CONTENT BEFORE RELYING ON IT.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. We may delete your data 30 days after termination unless required to retain it by law.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

14. Payment Security

All payment processing for LaunchChat is handled by Creem, our Merchant of Record. LaunchChat does not directly process, store, or transmit any payment card information.

  • No Card Storage: LaunchChat never sees, stores, or has access to your full credit card number, CVV, or other sensitive payment data.
  • PCI DSS Compliance: Creem, as our payment processor, is PCI DSS compliant, ensuring your payment information is handled according to the highest industry security standards.
  • Encryption: All transactions are protected with TLS (Transport Layer Security) encryption between your browser and the payment processor.

15. Dispute Resolution and Chargebacks

We are committed to resolving any billing disputes fairly and promptly.

  • Contact Us First: If you believe you have been charged in error or are dissatisfied with your purchase, please contact us at support@launchchat.dev before initiating a chargeback with your bank.
  • Merchant of Record: Because Creem acts as the Merchant of Record, chargebacks are processed through Creem. We will cooperate fully with any dispute resolution process.
  • Chargeback Impact: Filing a chargeback without first contacting us may result in your account being suspended pending resolution. We aim to resolve all disputes within 5 business days.
  • Escalation: If we cannot resolve your dispute directly, you may escalate to Creem's support team or your local consumer protection authority.

16. Billing Cycle Details

The following details explain how billing works for LaunchChat subscriptions:

  • Billing Date: Your subscription renews on the same calendar date each month (or year for annual plans) as your original purchase. If that date does not exist in a given month, you are billed on the last day of that month.
  • Failed Payments: If a payment fails, we will retry up to 3 times over a 10-day period. If all retries fail, your account will be downgraded to the Free plan and your data will be preserved for 30 days.
  • Plan Changes: Upgrades take effect immediately and are prorated for the remainder of your current billing cycle. Downgrades take effect at the start of the next billing cycle.
  • Lifetime Purchases: Lifetime plan purchases are one-time payments with no recurring charges. Access is granted indefinitely under the terms in effect at the time of purchase.
  • Currency: All prices are listed in USD. If your payment method uses a different currency, conversion is handled at checkout by your bank or Creem at the prevailing exchange rate.
